The deadline is 31 December 1989 for landowners covered by RA 6657, Section 7, Phases I and II, to avail of the Voluntary Offer to Sell (VOS) scheme.
No, lands for which notices of coverage for compulsory acquisition have already been sent and received may no longer be voluntarily offered for sale.
Failure to avail the VOS by 31 December 1989 results in the landholdings being subjected to compulsory acquisition by the government.
Landowners with holdings: (a) above 24 hectares up to 50 hectares whose acquisition is due on 15 June 1992 have until 15 June 1991, and (b) those with holdings from the retention limit up to 24 hectares whose acquisition is due on 15 June 1994 have until 15 June 1993 to avail the VOS.
The landowner must accomplish and submit CARP VOS Forms Nos. 1 and 1.a along with the required supporting documents to the MARO.
The MARO prepares the Voluntary Offer Claim Folder, conducts ocular inspections, accomplishes investigation reports, ensures completeness of forms, conducts the preliminary conference, and submits the case folder to the Provincial Agrarian Reform Officer within 30 working days.
The PARO processes the case according to Administrative Order No. 12, Section II, Subsection B, except lands offered before 15 June 1988 are valued as per Administrative Order No. 5, completes processing within 10 working days, and forwards the folder to the DAR Central Office or Regional Director.
They review and evaluate the case within 5 working days, prepare a Summary Review and Evaluation Report stating valuation, submit the report and case folder to the LBP President, and prepare a Notice of Acquisition for the DAR Secretary's signature.
The LBP President notifies the DAR Secretary stating reasons for disagreement and proposes an alternative compensation amount. A DAR-LBP Committee then meets monthly to reach consensus on the compensation amount.
The property is subjected to compulsory acquisition. The DAR Adjudication Board conducts a summary administrative hearing to determine just compensation, after which the Order of Acquisition and Deed of Transfer are prepared for signatures.
