Legal basis and predecessor law
- Presidential Decree No. 1110 is issued by the President by virtue of the power vested in him by the Constitution.
- The decree amends Section 4 of Republic Act No. 3680.
- The governing-law mechanism modifies the composition of the Philippine Merchant Marine Academy Board established under Republic Act No. 3680.
Policy and intent for governance change
- The decree recognizes that Presidential Decree No. 474 tasks the Maritime Industry Authority to establish a system for maintaining and developing a reservoir of trained manpower for the maritime industry.
- It seeks to upgrade maritime educational and training institutions and programs to supply shipping and shipyard manpower needs.
- It targets the Philippine Merchant Marine Academy as a major institution producing efficient and well-trained merchant marine officers.
- It provides that the Academy is under the administrative supervision of the Maritime Industry Authority.
- It mandates a change in the Academy’s governing body composition to ensure a more active, positive, and effective participation by the Authority.
Board composition amended under RA 3680
- Section 1 amends Section 4 of Republic Act No. 3680 by replacing its text on board composition.
- The Academy’s government is vested in the Philippine Merchant Marine Academy Board.
- The Board is composed of the following members:
- the Administrator of the Maritime Industry Authority, who serves as ex-officio Chairman of the Board;
- a representative of the Philippine Navy;
- the Chairman of the Board of Marine Inquiry;
- the Chairman of the Board of Marine Examination for Deck Officers;
- the Chairman of the Board of Marine Examination for Marine Engineers;
- the President of the United Harbor Pilots Association of the Philippines;
- the President of the Filipino Shipowners Association;
- the Executive Director of the National Seamen Board;
- the Superintendent of the Academy.
- Board membership is structured so that the Administrator of the Maritime Industry Authority leads the Board ex-officio.
Compensation rule for Board members
- Section 1 provides that Board members serve without compensation.
- Board members may receive actual and necessary expenses incurred:
- in attendance upon meetings of the Board; or
- upon official business authorized by a resolution of the Board.
Repeal or modification and enforcement
- Section 2 repeals or modifies all provisions of existing laws, decrees, orders, rules, and regulations, or parts thereof, that are in conflict or inconsistent with the decree.
- Section 3 states the decree’s effectivity is immediate.
