Reservation and Specification of Land Areas for Housing and Allied Structures
- Repeals and amends previous proclamation to reserve 12-meter strips of Berm lands along both sides of the Manggahan Floodway.
- Covers areas in Cainta, Taytay (Rizal Province) and Pasig City (Metro Manila) from Station 1+150 to 8+900 of the master plan.
- Designated for development of medium-rise socialized and low-cost housing for urban poor and deserving landless-homeless employees.
- Includes detailed delineation of 18 land parcels on the East Berm Slope and 8 land parcels on the West Berm Slope, including precise boundaries, coordinates, and land areas.
Allocation of Land for Industrial and Livelihood Projects
- Segregates two large parcels from the reserved land for industrial development and livelihood projects.
- East Embankment: Parcel I-A of approximately 129,990 sqm at Brgy. San Juan, Taytay, Rizal.
- West Embankment: Parcel II-A of approximately 119,700 sqm at Brgy. San Juan, Taytay, Rizal.
- Purpose: To support small and medium-scale entrepreneurs engaged in livelihood projects, fostering economic development.
Government Agency Responsibilities and Directives
- Department of Environment and Natural Resources (DENR) Regional Office IV and Department of Public Works and Highways (DPWH) directed to conduct final survey for project development.
- Home Guaranty Corporation tasked with issuing Guaranty Certificates for investors under the supervision of the Housing and Urban Development Coordinating Council (HUDCC).
- Land Management Bureau mandated to issue Special Patents for designated parcels.
Terms of Use and Restrictions on Conveyance
- Lands reserved for housing and allied structures to be used exclusively for these purposes in perpetuity.
- Segregated parcels designated for livelihood projects and sanitary waste disposal facilities, including garbage segregation, decomposition systems, and wastewater treatment plants, to protect Laguna Lake.
- Beneficiaries of the housing project are restricted from alienation, conveyance, encumbrance, or leasing of the lands for ten (10) years following issuance of Deed of Conveyance.
- Exceptions to alienation restrictions apply only in favor of government or as otherwise determined by concerned government agencies.
Environmental and Social Objectives
- Project aims to prevent further environmental degradation caused by informal settlements.
- Integration of sanitary waste management systems to safeguard water quality and ecological balance of Laguna Lake.
- Provides housing solutions for approximately 6,700 urban poor families and deserving landless-homeless employees of the Rizal Provincial Government.
Legal Formalities and Execution
- The law is enacted by the President under her legal authority, following recommendations from government agencies including province of Rizal, PCRGA, PCUP, CDA, DENR, and approval from HUDCC.
- Official coordinates, boundary descriptions, and sketches accompany the proclamation for clear demarcation.
- The proclamation is formally signed by the President and Executive Secretary, with the seal of the Republic affixed, effectuating the amendment and reservation of lands.
