Questions (PROCLAMATION NO. 1160)

Proclamation No. 1160 amends Proclamation No. 458 and reserves twenty parcels of land at the Manggahan Floodway Complex for the construction of medium-rise socialized and low-cost housing projects and allied structures for the benefit of approximately 6,700 urban poor families and deserving landless-homeless employees of the Provincial Government of Rizal.

The government aimed to strengthen the implementation against squatting to prevent environmental degradation caused by informal settlers who discharge garbage and sewer waste into the Manggahan Channel and Laguna Lake, thus protecting ecological sanitation and aquatic resources.

The agencies involved included the Provincial Government of Rizal, PCRGA, PCUP, CDA, DENR, and the approval of HUDCC as per the Memorandum of Agreement dated January 8, 2002.

These berm lands have been repealed, included, and reserved specifically for the development of medium-rise housing and allied structures, as declared by Proclamation No. 1160.

There are ten parcels (I-B-1 to I-B-10) included in the East Berm Slope. One key characteristic is that Parcel I-B-1 contains approximately 11,653 square meters and is bounded on several sides by the Manggahan Channel, East Service Road, and concrete lining.

The southeast portion, consisting of 129,990 square meters from Parcel I and 119,700 square meters from Parcel II, is designated for industrial development and perpetual use by small and medium-scale entrepreneurs to support livelihood projects.

The Department of Environment and Natural Resources (Region IV) and the Department of Public Works and Highways were directed to immediately undertake the final survey of the area for early development and project completion.

The HGC is directed to issue a Guaranty Certificate requirement for investors, subject to the strict control and supervision of the Housing and Urban Development Coordinating Council (HUDCC).

Beneficiaries are prohibited from alienating, conveying, encumbering, or leasing the land for a period of ten years from the issue of the Deed of Conveyance, except in favor of the government or as the government agency concerned may determine.

The proclamation mandates that the segregated portion of the land is to be used for livelihood projects and sanitary waste disposal facilities, including garbage segregation, decomposing systems, and wastewater treatment plants to protect environmental sanitation and preserve the Laguna Lake.
