Fees Payable to Clerk of Court

  • Filing fee for land registration application is based on the assessed value of the property with five graduated brackets:
    • Up to ₱2,000: ₱15 for the first ₱500, ₱5 for each additional ₱500.
    • ₱2,000 to ₱10,000: ₱35 for first ₱3,000, ₱5 for each additional ₱1,000.
    • ₱10,000 to ₱100,000: ₱80 for first ₱20,000, ₱10 for each additional ₱10,000.
    • ₱100,000 to ₱500,000: ₱180 for first ₱125,000, ₱20 for each additional ₱25,000.
    • Above ₱500,000: ₱520 for first ₱550,000, ₱40 for each additional ₱50,000.
  • In absence of tax assessment, fees are based on market value supported by a sworn declaration by three disinterested persons.
  • Additional fees include ₱6 per petition for claims adverse to registered owners, ₱3 for petitions after final decisions, with adjustments for multiple cases and individual petitioners.

Fees Payable to the Sheriff

  • Fees for posting notices related to land registration and cadastral cases:
    • ₱3 per land parcel/posting plus travel fees.
    • ₱3 per 100 cadastral lots plus travel fees.
    • ₱2 for posting notice on municipal building plus travel fees.
  • Travel fees apply to serving notices to cadastral claimants as per Rules of Court.
  • Other services charged according to similar fees prescribed in Rules of Court including travel fees.

Fees Payable to Register of Deeds

  • Charges for various services such as:
    • ₱6 for entry and issuance of original and duplicate certificate of title, with extra ₱1 for each additional parcel.
    • ₱0.50 per primary entry book entry.
    • ₱1.50 for annotations like attachment, lis pendens, consolidated ownership affidavit, release of encumbrance.
    • ₱3 for court-ordered inclusion of buildings/improvements when belonging to a different owner.
    • ₱5 for registering corporate and fiduciary documents; ₱1 for annotations on titles.
    • ₱1 per certificate for tax lien notices, lost certificate notices etc.
    • Fees for transfer certificates depending on the person involved, with additional charges per parcel.
    • ₱1 for first page and ₱0.50 for each subsequent page of title duplicates.
  • Registration fees for conveyances and other instruments are based on the value of consideration with graduated brackets:
    • Example brackets range from ₱3 plus ₱1 per ₱500 for values up to ₱6,000, and adjust upwards to ₱410 plus ₱10 per ₱20,000 for values above ₱500,000.
  • Special bases for fee computation in cases of exchanges, hereditary transmissions, partitions, multiple parties, leases, and contracts without fixed considerations.
  • Fees for copies, certifications, and certificates of existing records vary from ₱0.20 per 100 words to ₱2 per certificate.

Effective Date

  • The amended fees schedule and provisions shall take effect upon approval of the Act on June 7, 1947.
