Republic Act No. 117 amends Section 114 of Act No. 496, the Land Registration Act, fixing a new schedule of fees payable to clerks of courts, sheriffs, and registers of deeds for services in connection with land registration and cadastral proceedings.
The fees payable are based on the assessed value of the property for the current year, with specific amounts depending on value brackets, starting from fifteen pesos for properties valued up to two thousand pesos, with incremental charges for higher-valued properties.
The applicant must base the fees on the current market value and file a sworn declaration from three disinterested persons that the fixed value is a fair valuation.
The fee is six pesos for each petition filed.
The sheriff collects three pesos for each parcel of land on which the notice is posted, in addition to travel fees.
Six pesos for the first parcel of land described, and one peso for each additional parcel; in cadastral titles valued up to five hundred pesos, the fee is one peso for every one hundred pesos or fractional part thereof.
One peso and fifty centavos per parcel, but total collected fees shall not exceed the fees originally paid for registering the mortgage or encumbrance.
Fees are based on the consideration value according to a schedule ranging from three pesos plus one peso per additional 500 pesos for transactions up to six thousand pesos, with higher schedules for greater values, up to charges for values exceeding five hundred thousand pesos.
Five pesos for registration and filing, and one peso for the annotation of such papers on certificates of title when required.
Fifty centavos for each certification certificate provided.
