Company Profile Requirements for Applicants (Provision 3.1)
- Exclusive Distributorship Agreement: Applicants must hold an exclusive distributorship agreement authorized by the manufacturer/principal.
- Notarization and Authentication: The distributorship agreement must be notarized in the country of origin and authenticated by the Philippine Consular Office.
- Nature of Business for Corporations: The importing, exporting, sale, and distribution of medical, hospital, dental, laboratory, or radiological equipment must be expressly stated in the Articles of Incorporation.
- Single Product Line Restriction: Corporations, whether parent or subsidiaries/consortium, may carry only one product line within a particular genus of equipment to prevent monopoly, collusion, or circumvention of guidelines.
Track Record Requirements (Provision 3.2)
- For New Applicants (3.2.a): At least 20% of customers or clients over the previous two years must be from the private sector (local or foreign).
- For Newly Incorporated Applicants under Corporation Law (3.2.b): Must wait for two years unless subsidiary/consortium of an accredited parent company with impeccable DOH track record.
- Conditions for Subsidiaries (3.2.b.1 - 3.2.b.2):
- Parent company must be operational, not under financial distress, dissolution, or liquidation.
- A Board Resolution from the parent company must guarantee full financial support to the subsidiary until compliance with 3.2.a within two years.
Accreditation Certificate Issuance and Fee Structure (Provision 4.5)
- Accreditation Fee: One thousand pesos (P1,000.00) per brand per category per year or fraction thereof.
- Certificate Contents: Specifies supplier classification, category, brand, product/equipment carried, and expiration date of exclusive distributorship.
- Issuing Authority: Committee for Accreditation of Medical Equipment Suppliers and Medical Equipment Repair Shop.
- Approval: By the Undersecretary of Health, Health Regulation Cluster.
Continuity of Other Provisions and Effectivity
- All other provisions of Administrative Order No. 33, s. 2001 remain effective and unchanged.
- The amendment takes effect immediately upon publication in a newspaper of general circulation.
