Authority and legal basis
- The President issued Presidential Decree No. 1022 by virtue of the powers vested by the Constitution.
- The President acted to effect needed corrections of typographical errors and minor amendments of an existing law, namely Presidential Decree No. 1006.
- Section 1 and Section 2 directly amend Sections Six and Seven of Presidential Decree No. 1006.
- Section 1 and Section 2 operate through textual replacement of the amended provisions.
Amendments to Section Six (screening, approvals, permits)
- Section 1 amends the last paragraph of Section Six of Presidential Decree No. 1006.
- The amended rule requires that these offices shall screen and approve applications.
- The amended rule requires that these offices shall issue the corresponding permits to take the examination to qualified applicants.
- The screening, approval, and permit issuance are tied to applications for taking the examination under Presidential Decree No. 1006.
Amendments to Section Seven (appointment, confidentiality, fees)
- Section 2 amends Section 7 of Presidential Decree No. 1006, governing the appointment of examiners.
- The Board must appoint a set of examiners for every examination.
- Examiners must be recognized authorities in teacher education.
- The examiners’ names must not be disclosed until after the release of the results of the examination.
- Each examiner receives compensation not less than P5.00 per examinee.
- Each examiner’s compensation has an upper limit of no more than P18,000.00 per examination.
- If an examiner is in the service of the Government, the examiner receives the compensation in addition to salary and any provision of law to the contrary notwithstanding.
Implementation and responsible bodies
- The offices referenced in Section Six perform the functions of screening and approving applications and issuing permits to qualified applicants.
- The Board performs the function of appointing examiners for every examination.
- The Board determines compensation “as may be determined by the Board” within the minimum and maximum limits fixed by Section 7.
- The confidentiality rule binds the disclosure of examiners’ names until after results are released.
Effect, scope of amendments, and separability
- Section 1 amends only the last paragraph of Section Six of Presidential Decree No. 1006.
- Section 2 amends only Section Seven of the same decree.
- Section 3 provides immediate effect upon issuance of Presidential Decree No. 1022.
- No penalty, sanction, or separate repealing or separability clause is established in Presidential Decree No. 1022.
