Legal basis and cited framework
- Executive Order No. 433 is anchored on the President’s continuing authority to reorganize the administrative structure of the Office of the President under paragraph 2, Section 31, Chapter 10, Title III, Book III of the Administrative Code of 1987.
- Executive Order No. 433 recognizes that Executive Order No. 81 (March 5, 1999) previously transferred the management of DepEd sports programs and activities to the PSC.
- Executive Order No. 433 reflects Republic Act No. 9155 as the governing statute for the basic education system, treating physical education and school sports as integral to the basic education curriculum implemented by DepEd.
- Executive Order No. 433 takes into account the Implementing Rules and Regulations of EO No. 81, which had placed PSC in charge of managing and implementing the Palarong Pambansa.
Policy and intent for transferring Palaro
- Executive Order No. 433 provides that the transfer serves the national school sports program by returning management of Palarong Pambansa to DepEd.
