Amendment Excluding PUP Sto. Tomas from BSU

Republic Act No. 9472 amends Section 1 and Section 16 of Republic Act No. 9045.

Republic Act No. 9472 amends the title of Republic Act No. 9045.
Republic Act No. 9472 repeals, modifies, or amends all laws, presidential decrees, executive orders, and issuances, including conflicting parts of any other issuances, that are contrary to or inconsistent with Republic Act No. 9472.

Section 1 (as amended by Republic Act No. 9472) integrates specific schools into Batangas State University (BSU), to be known as the University.
The integrated institutions include the Pablo Borbon Memorial Institute of Technology in the City of Batangas, including its branches in Barangay Alangilan of the same city, and branches in the municipalities of Balayan, Bauan, Lobo, San Pascual, Rosario, Taysan, Padre Garcia, Lemery, Calaca, Taal, Tanauan, San Juan, and Lipa City.
The integrated institutions also include the Jose P. Laurel Polytechnic College in Malvar and the Apolinario R. Apacible School of Fisheries in Nasugbu.
The main campus of the University in the City of Batangas is named as the Pablo Borbon Campus.

Section 16 (as amended by Republic Act No. 9472) transfers to the University all assets, fixed and movable, personnel, and records of the integrated institutions, including the described branches and schools located in Batangas.
The transfer also covers liabilities or obligations of the transferred institutions to the University.
Section 16 provides that the positions, rights, and security of tenure of personnel employed under existing laws prior to absorption by the University are not impaired.
Section 16 provides that incumbents of existing positions remain in the same status until otherwise provided by the Board.
Section 16 declares that all parcels of land belonging to the government and occupied by the named institutions are the property of the University and must be titled under the name of the Batangas State University.
Section 16 provides that if the University cease to exist or be abolished, or if such parcels of land are no longer needed by the University, the parcels revert to the provinces, municipalities, or cities where they are located.

Section 21 (as amended by Republic Act No. 9472) charges the amount necessary to carry out the Act against the current year’s appropriations of the Pablo Borbon Memorial Institute of Technology, Jose P. Laurel Polytechnic College, and Apolinario R. Apacible School of Fisheries.
After the current year, Section 21 directs that sums necessary for the continued operation and maintenance of the University shall be included in the annual General Appropriations Act.

Section 4 (as amended by Republic Act No. 9472) amends the title of Republic Act No. 9045 to reflect integration of:
- Pablo Borbon Memorial Institute of Technology, including branches in Barangay Alangilan, Batangas City, and in the listed municipalities and city;
- Jose P. Laurel Polytechnic College in Malvar; and
- Apolinario R. Apacible School of Fisheries in Nasugbu.
The amended title retains the same overall purpose: creating BSU, appropriating funds, and for other purposes.

Section 5 (as amended/covered by Republic Act No. 9472) repeals, modifies, or amends all laws, presidential decrees, executive orders, and issuances, including parts thereof, that are contrary to or inconsistent with Republic Act No. 9472.
