Questions (Republic Act No. 9472)

RA 9472 amends Republic Act No. 9045, which created the Batangas State University (BSU), by changing BSU’s coverage/integration provisions so that certain institutions are included and a specific one is excluded.

The Pablo Borbon Memorial Institute of Technology (including listed branches) is integrated, along with the Jose P. Laurel Polytechnic College in Malvar and the Apolinario R. Apacible School of Fisheries in Nasugbu.

It provides that the main campus in the City of Batangas shall be named as the Pablo Borbon Campus.

The law’s title states that RA 9472 excludes the Polytechnic University of the Philippines (PUP) campus in Sto. Tomas, Batangas, from the coverage of BSU as created by RA 9045 and amended by RA 9472.

All assets (fixed and movable), personnel, and records of the named institutions and their branches are transferred to BSU, together with liabilities or obligations.

No. RA 9472 expressly states that positions, rights, and security of tenure of personnel employed under existing laws prior to absorption are not impaired.

Incumbents remain in the same status until otherwise provided by the Board.

Parcels of land belonging to the government and occupied by those institutions are declared to be property of BSU and shall be titled under the name of BSU.

If BSU ceases to exist or is abolished, or if the parcels are no longer needed by BSU, the same shall revert to the provinces, municipalities, or cities where they are located.

It charges the amount necessary to carry out the Act against the current year’s appropriations of the Pablo Borbon Memorial Institute of Technology, the Jose P. Laurel Polytechnic College, and the Apolinario R. Apacible School of Fisheries; thereafter, future sums for BSU operations are included in the annual General Appropriations Act.

It becomes an Act creating BSU by integrating (1) Pablo Borbon Memorial Institute of Technology (including listed branches), (2) Jose P. Laurel Polytechnic College, and (3) Apolinario R. Apacible School of Fisheries, appropriating funds therefor, and for other purposes.

It repeals, modifies, or amends all laws, presidential decrees, executive orders, and issuances or parts thereof that are contrary to or inconsistent with its provisions.

It takes effect fifteen (15) days after its publication in two newspapers of general circulation.

It states that the bill originated in the House of Representatives and was passed by the House on June 8, 2006 and by the Senate on February 19, 2007, with approval on May 22, 2007—showing the sequence of enactment.

RA 9472 amends the coverage/integration, asset/personnel transfer, funding, and caption of RA 9045 so that BSU’s integrated institutions are as enumerated in the amended provisions, while the PUP Sto. Tomas campus is excluded.
