Reynaldo I. Berroya mandates the strict enforcement of a prohibition on the registration of All Terrain Vehicles (ATVs) until proper classification and guidelines are established, requiring immediate apprehension of non-compliant vehicles and imposing administrative sanctions for violations.

Treatment of Previously Registered ATVs

  • No renewal of registration for ATVs that were registered prior to the implementation of this Memorandum Circular.
  • ATVs operated on public highways are subject to apprehension.
  • Upon apprehension, the vehicle’s license plate shall be confiscated.
  • The Certificate of Registration (CR) and Official Receipt (OR) must be cancelled for these ATVs.

Fees and Data Management

  • Instead of registration renewal, owners must pay a recording fee of P500.00 per year as mandated by Section 3 of Republic Act No. 8794.
  • Additional fees including the cost of the sticker, Information Technology (IT) fee, and License and Regulatory Fee (LRF) must also be collected.
  • A dedicated data record for ATVs must be created and maintained in the Land Transportation Office (LTO) database.

Enforcement and Sanctions

  • All concerned employees and officials are mandated to strictly implement the memorandum’s prohibitions and guidelines.
  • Violation of this Memorandum Circular by any official or employee will result in administrative sanctions pursuant to Civil Service Commission rules and regulations.

Effectivity and Supersession

  • The Memorandum Circular takes immediate effect from the date of issuance.
  • All previous issuances and directives that conflict with this Memorandum Circular are deemed superseded.
  • Strict compliance is required from all offices and employees involved in vehicle registration and enforcement.
