Title
Flexible Work Schedule in Office of the President
Law
Memorandum Order No. 125
Decision Date
Dec 11, 2003
A memorandum order in the Philippines allows for a flexible work schedule in the Office of the President to accommodate employees who commute from far-away places, with guidelines provided for two work schedule options and consequences for tardiness and undertime.

Policy objective and coverage

  • The order adopts a flexible work schedule in the Office of the President (Proper) in the interest of employees, especially those who commute from far-away places.
  • The order establishes rules applicable to all employees of the Office of the President (Proper).
  • The order requires heads of offices to ensure that public service is not prejudiced.
  • The order allows special groups of employees to follow schedules appropriate to their work.

Official working hours and lunch break

  • The Official Working Hours are from 7:00 AM to 5:30 PM, Mondays to Fridays.
  • The lunch break runs from 12:00 nn to 1:00 pm.
  • When an employee takes the lunch break, the interval between time-out and time-in must be at least thirty (30) minutes.

Daily work requirement and allowable schedules

  • All employees must complete at least eight (8) hours of work per day.
  • Each employee may choose one of these work schedules:
    • 7:00 am to 4:00 pm
    • 8:00 am to 5:00 pm
  • Regardless of the chosen schedule, all rules on attendance at required activities apply.

Core working time and attendance rules

  • The Core Working Time is from 8:30 am to 4:00 m.
  • An employee who reports after the start of the Core Working Time is considered tardy.
  • A tardy employee is barred from off-setting tardiness if the employee reports after the start of the Core Working Time.
  • An employee who leaves before the end of the Core Working Time is considered on undertime.

Off-setting late reporting and undertime deductions

  • If an employee reports after the start of the chosen work schedule but on or before the start of the Core Working Time, the employee must off-set the lateness for the corresponding length of time to complete the required eight (8) hours of work per day.
  • If an employee fails to off-set the length of time late in reporting, the employee is considered on undertime.
  • When an employee is on undertime due to failure to off-set, corresponding deductions are made from leave credits.

Required weekly attendance and public service safeguards

  • All employees must attend the Flag Raising Ceremony every Monday.
  • Heads of offices must ensure that public service is not prejudiced despite the flexible work schedule.
  • Each head of office must prepare a fair and equitable distribution of employees between the two (2) flexible work schedules.

Filing and timing of distribution plan

  • Every head of office must submit the fair and equitable distribution of employees between the two (2) flexible work schedules to the Personnel Office.
  • The submission must be made not later than three (3) days from the effectivity of the Memorandum Order.

Special employee groups and work-appropriate schedules

  • Special groups of employees—Household, Engineering and Communication personnel, drivers, janitors, and utility aides—may be required to follow a schedule appropriate to the nature of their work.
