Title
Flexible Work Schedule in Office of the President
Law
Memorandum Order No. 125
Decision Date
Dec 11, 2003
A memorandum order in the Philippines allows for a flexible work schedule in the Office of the President to accommodate employees who commute from far-away places, with guidelines provided for two work schedule options and consequences for tardiness and undertime.

Questions (MEMORANDUM ORDER NO. 125)

It is pursuant to Section 6, Rule XVII of the Omnibus Rules Implementing Book V of the Administrative Code of 1987.

From 7:00 AM to 5:30 PM, Mondays to Fridays, with a lunch break from 12:00 nn to 1:00 PM.

All employees must complete at least eight (8) hours of work per day.

Either (1) 7:00 AM to 4:00 PM or (2) 8:00 AM to 5:00 PM.

Core Working Time is from 8:30 AM to 4:00 PM. An employee who reports after the start of Core Working Time is considered tardy and will be barred from offsetting the tardiness.

The employee is considered on undertime.

He must off-set the time he was late in reporting, in the corresponding length of time needed to complete the required eight (8) hours of work per day.

He is considered on undertime, and the corresponding deductions are made from his leave credits.

The interval between time-out and time-in for lunch must be at least thirty (30) minutes.

No. Regardless of the work schedule chosen, all employees are required to attend the Flag Raising Ceremony every Monday.

They must ensure public service is not prejudiced, including preparing a fair and equitable distribution of employees between the two flexible schedules.

Not later than three (3) days from the effectivity of the Memorandum Order.

Special groups (Household, Engineering and Communication personnel, drivers, janitors, utility aides) may be required to follow a schedule appropriate to the nature of their work.

It takes effect immediately.

Since 8:10 AM is after the chosen schedule start but on or before the start of Core Working Time (8:30 AM), the employee must off-set the corresponding lateness to still complete eight (8) hours, subject to the rules stated in the memorandum.

No. If the employee reports after Core Working Time begins, they are considered tardy and are barred from offsetting the tardiness.
