Legal basis and constitutional policy
- Section 15, Article II of the Constitution declares State policy to protect and promote the right to health and install health consciousness among the people.
- Section 3 of Republic Act No. 11223 (Universal Health Care Act of 2019) requires a whole-of-system, whole-of-government, and whole-of-society approach in developing, implementing, monitoring, and evaluating health policies, programs, and plans.
- Republic Act No. 11223 anchors the PHFDP 2020–2040 as consistent with Universal Health Care framework and people-oriented delivery of health services.
- The Circular aligns PHFDP 2020–2040 implementation with the broader development strategy under Philippine Development Plan 2023–2028 on boosting health through accessible, efficient, and strengthened health care systems.
Purpose and declared intent
- The Circular adopts PHFDP 2020–2040 as the national strategy to ensure a strong primary care and integrated health system for every Filipino.
- The Circular requires government support and cooperation to ensure success of PHFDP 2020–2040 implementation.
- The Circular targets improved health facility development by directing agencies and encouraging LGUs to undertake coordinated efforts under PHFDP 2020–2040 plans and programs.
- The Circular requires national and local efforts to translate PHFDP 2020–2040 into long-term local health facility planning.
Directives to national government agencies and LGUs
- National agencies and instrumentalities must undertake efforts in support of the implementation of PHFDP 2020–2040.
- Government-owned or -controlled corporations must undertake efforts in support of the implementation of PHFDP 2020–2040.
- LGUs are encouraged to undertake efforts in support of the implementation of PHFDP 2020–2040.
- All concerned agencies, instrumentalities, and LGUs must implement efforts consistent with their mandates.
DOH implementation duties
- The Department of Health (DOH) is directed to facilitate dissemination and ensure effective and efficient implementation of PHFDP 2020–2040 at the LGU level.
- The DOH must assist, guide, and support LGUs in translating PHFDP 2020–2040 into long-term local health facility development plans.
- LGU translation must be reflected in Local Investment Plans for Health and Local Development Investment Programs.
- The DOH must coordinate with LGUs to formulate policies relative to the establishment of Primary Care Provider Networks and Health Care Provider Networks.
- The DOH must monitor implementation of PHFDP 2020–2040 and the development of local health facilities, and must submit annual reports to the Office of the President, through the Office of the Executive Secretary, on progress and operation.
- The DOH must encourage LGUs to enter into Public-Private Partnerships (PPPs) to address gaps identified in PHFDP 2020–2040.
- The Circular authorizes LGUs, with DOH encouragement, to seek PPP Center assistance for technical trainings and capacity-building on the development and implementation of relevant PPP projects.
- The DOH must issue necessary guidelines to effectively implement the Circular, and the DOH may request assistance of other relevant government agencies and offices for guideline formulation.
Incentives and private investment policies
- The DOH, in coordination with the Department of Trade and Industry–Board of Investments and the Fiscal Incentives Review Board, must study, formulate, and implement policies that encourage domestic and international enterprises from the private sector.
- The policy objective for private investment is to build health facilities aimed at addressing gaps identified in PHFDP 2020–2040.
Funding, budgeting, and effectivity
- The funding requirements for implementation of the Circular must be charged against the existing appropriations of the respective agencies and LGUs.
- Funding is subject to availability, consistent with applicable budgeting, accounting, and auditing laws, rules and regulations.
- Memorandum Circular No. 26 takes effect immediately upon publication in the Official Gazette or in a newspaper of general circulation.
- The Circular is dated July 25, 2023 and signed in Manila on that date.
- The Circular is published in 119 OG No. 32, 5980 (August 7, 2023), reflecting the Official Gazette publication record.
