Law Summary
Operationalization and Funding of the New RTC Branches
- The Chief Justice of the Supreme Court, in coordination with the Secretary of the Department of Justice, shall include these four additional RTC branches in the Court's operational program immediately.
- Funding for these new branches must be incorporated into the annual General Appropriations Act.
- Appropriations and release of funds for the operation of the newly created courts will occur only after the courts are fully organized and personnel have been appointed.
Amendment to Existing Laws
- Section 14(j) of Batas Pambansa Blg. 129, also known as the Judiciary Reorganization Act of 1980, as amended, is modified to accommodate the creation of the additional RTC branches.
- All other laws, rules, and regulations inconsistent with this Act are amended, repealed, or modified accordingly to harmonize with the new provisions.
Effectivity of the Act
- The Act takes effect fifteen (15) days after its complete publication in the Official Gazette or in two newspapers of general circulation.
Important Legal Concepts and Procedures
- The Supreme Court holds exclusive authority to assign branch numbers and organize the new RTC branches.
- Collaboration between the judiciary (Supreme Court), the Department of Justice, and the legislative funding process ensures proper implementation.
- Funding is conditional upon the actual organization and staffing of the courts, preventing premature appropriation.
- The amendment of existing judiciary laws ensures legal consistency and integration of the new branches within the justice system.
