Court branches created and seat distribution
- Section 1 creates five (5) additional Regional Trial Court branches in the Fourth Judicial Region.
- Section 1 provides that three (3) seats are stationed at the City of Calamba.
- Section 1 provides that one (1) seat is stationed at Los Baños.
- Section 1 provides that one (1) seat is stationed at Cabuyao.
- Section 1 directs that the Supreme Court assigns the branch number of the newly created branches in the Fourth Judicial Region.
Operationalization and funding conditions
- Section 2 requires the Chief Justice of the Supreme Court, in coordination with the Secretary of the Department of Justice, to include in the Court’s program the operationalization of the five (5) additional branches.
- Section 2 requires the funding for operationalization to be included in the annual General Appropriations Act.
- Section 2 provides that the funds necessary for operation shall be appropriated and released only upon the actual organization of the courts created by Republic Act No. 10339.
- Section 2 links actual release of funds to appointment of the personnel of the newly created courts through the requirement of actual organization.
Implementation rules and territorial jurisdiction
- Section 3 directs the Supreme Court to issue the necessary rules and regulations for effective implementation of Republic Act No. 10339.
- Section 3 authorizes the Supreme Court to realign the seats of existing branches and their territorial jurisdiction if warranted.
Amendments and repeal of inconsistent rules
- Section 4 amends Section 14(e) of Batas Pambansa Blg. 129.
- Section 4 provides that all other laws, rules, and regulations inconsistent with Republic Act No. 10339 are amended, repealed, or modified accordingly.
Effectivity and publication requirement
- Section 5 provides that Republic Act No. 10339 takes effect fifteen (15) days after its complete publication in the Official Gazette.
- Section 5 also provides that effectivity may occur after complete publication in two (2) newspapers of general circulation.
- Section 5 makes publication the decisive condition for effectivity, measured by the fifteen (15) days countdown after complete publication.
