Scope and Jurisdiction
- The requirement applies to all operators of public land transportation services within the jurisdiction of the LTFRB.
Penalties for Non-Compliance
- The memorandum sets a progressive penalty system for failure to comply with the accident reporting requirements:
- First Offense: Fine of PHP 3,000.00
- Second Offense: Fine of PHP 5,000.00
- Third Offense: Fine of PHP 10,000.00
- Fourth Offense: Suspension of the Certificate of Public Convenience (CPC) for 60 days
- Fifth Offense: Revocation or cancellation of the CPC
Legal Framework and Effectivity
- This directive is based on Section 14 of Revised Order No. 1, which implements the Public Service Act.
- The memorandum circular takes effect 15 days after filing three copies with the University of the Philippines Law Center, consistent with Presidential Memorandum Circular No. 11, dated October 9, 1992.
- All prior issuances inconsistent with this memorandum are modified, superseded, or revoked accordingly.
Administrative Authority
- The LTFRB has the authority to impose penalties for violations as specified, reinforcing regulatory compliance among public land transportation service operators.
