Powers, Duties, and Functions of the National Planning Commission

Regional Planning Authority

Subdivision Code

  • Will compile regulations governing land subdivision in the Capital City and other urban areas.
  • Based on existing laws Executive Order No. 98 (1946) and Republic Act No. 333.

Building Code

  • Tasked to draft uniform regulations for building conservation, repair, and alteration.
  • Regulations aim to ensure structural safety, minimize fire hazards, and promote sanitary living conditions.
  • Building Code or amendments submitted to local legislative bodies for adoption and enforcement is local officials' responsibility.

Composition and Appointment of the Commission

  • Comprises a Chairman and six members, appointed by the President with Commission on Appointments' consent.
  • Members receive per diem compensation for meetings attended.
  • Members serve at the President's pleasure; temporary chairmanship appointed within the Commission.
  • Operates under direct supervision and control of the President.
  • President may assign technical adviser(s) to assist the Commission.

Administrative Staff and Appointments

  • Includes a permanent Director of Planning appointed by the President with Commission on Appointments' consent.
  • Director paid an annual salary and empowered to appoint planners, engineers, architects, economists, attorneys, and clerical staff subject to approval.

Salaries and Organizational Structure

  • All previous positions in abolished commissions are abolished.
  • A detailed salary scale and staffing organization is established, covering Chairman, Director, members, planners, engineers, clerks, draftsmen, enumerators, and support personnel.
  • Detailed divisions include National Regional Division, Urban Division, Zoning and Regulatory Division, Administrative Division, Accounting Unit, and Auditing Unit.
  • Annual operations budget includes salaries, sundry expenses (travel, communication, supplies, maintenance), and office furniture and equipment totaling approximately P187,180.

Transfer of Records and Assets

  • All records, properties, equipment, funds, legal claims, rights, obligations, and assets/liabilities of abolished commissions are transferred to the National Planning Commission.

Gratuity Provisions for Separated Employees

  • Savings from old commissions’ appropriations may be used to pay one month salary gratuity per year of service, capped at 12 months.
  • Employees with less than one year served receive half a month’s salary.
  • Rehired employees who previously received gratuity must refund unearned benefits.

Repeal of Inconsistent Laws

  • All provisions in Executive Order No. 98 (1946), Republic Act No. 333, and other conflicting acts/orders administrative orders repealed.

Effectivity

  • The Executive Order takes effect immediately from November 11, 1950.
