The main purpose of Executive Order No. 413 is to create an Inter-Agency Committee (IAC) to oversee the turnover and development of properties in Makati held by the Philippine Development Alternatives Foundation, Inc. (PDAF) and the Presidential Commission on Good Government (PCGG) to the National Government and the National Power Corporation (NPC).
The National Government of the Republic of the Philippines and the National Power Corporation (NPC) are the registered owners of the parcels of land located in Makati covered by TCT Nos. 458364, 458365, 458366, and 458367.
PDAF, formerly the Technological Resource Center Foundation, Inc. (TRCFI), had a lease contract with the National Government and NPC for the property at P1.00 per square meter per year for 25 years ending December 31, 2002. The PDAF also held control and management over the property as a surrendered asset of PCGG.
The IAC is composed of the Chairman who is the Executive Secretary, and Members including the President of the National Power Corporation, the General Manager of the Public Estates Authority, the Solicitor General, and the Government Corporate Counsel.
The IAC is empowered to identify and designate control over PDAF as a surrendered asset, formulate rules and guidelines for turnover, coordinate with COA for auditing, identify undeveloped property areas for projects, represent the National Government and NPC in matters affecting the property, and perform other functions as directed by the President.
The COA, through an Auditing Task Force (ATF), is to investigate, inventory, and audit the assets of the PDAF to assist the IAC in managing the property.
Yes, the IAC may, with Presidential approval, undertake and implement joint venture projects to develop idle portions of the property, provided all projects comply with existing laws, rules, and regulations governing public property use.
The NPC shall provide the Secretariat for the IAC, and expenses including honoraria for members (up to P6,000 per month) will be charged against NPC funds, subject to availability and applicable accounting and auditing rules.
The IAC must submit a report to the President for information and/or disposition within sixty (60) days of the issuance of the Executive Order.
Executive Order No. 413 took effect immediately upon its signing on May 19, 1997.
