The main purpose of Republic Act No. 11698 is to protect and promote the nation's heritage by establishing regulatory policies that encourage the preservation, maintenance, occasional use, and registration of vintage vehicles, thus fostering cultural preservation and providing opportunities for entrepreneurs and industries involved in vintage vehicle restoration.
A motor vehicle must be at least forty (40) years old reckoned from the date of manufacture to be classified as a vintage vehicle under Republic Act No. 11698.
Registered vintage vehicles may only be used occasionally for personal purposes and/or leisure driving. They must not be used as the owner's primary transportation means or for commercial or public utility purposes except for specific exceptions like motion pictures, advertisements, weddings, and motorcades. They are also prohibited from operating after sunset to sunrise unless equipped with appropriate lights.
Registered vintage vehicles are generally exempt from modern anti-pollution, safety, and other standards that were not in force at the time of their manufacture. However, vintage vehicles with modern engine replacements must comply with prevailing standards if the engine was manufactured after the effectivity of the Philippine Clean Air Act of 1999.
Permitted modifications include those made while the vehicle was in production or within ten years after production, improvements to brakes, suspension, axles, carburetors, use of modern engines of the same brand with similar specifications, and installation of aftermarket accessories like radios or air conditioning, provided these are safe and lawful.
The registration of a registered vintage vehicle is valid for three years and may be renewed. Upon expiration and failure to renew, the vehicle ceases to enjoy exemptions and privileges under the Act.
The prohibition on the importation, registration, and use of right-hand drive vehicles does not apply to vintage vehicles manufactured on or before December 31, 1970, in historically correct condition, or vessels intended for sanctioned racing or motorsport, provided they are driven safely on the right side of highways.
Documents required include Certificate of Stock Report, approved Motor Vehicle Inspection Report (MVIR), valid government-issued ID of owner, PNP-HPG Motor Vehicle Clearance Certificate, proof of Third Party Liability Insurance, certificate of title or commercial invoice, and a duly accomplished LTO application form for vintage vehicle registration.
Owners may apply for registration with notarized affidavits about loss, valid IDs, insurance proof, approved MVIR with photos, and an LTO application form. For vehicles with no prior registration, extra affidavits regarding ownership and clearances from police agencies are required, with a public notice published for objections and an additional fee.
Restoration shops accredited by the Department of Trade and Industry and involved in importing vintage vehicles or their restoration are eligible for fiscal and tax incentives under the CREATE Act and other applicable laws, subject to compliance with requirements and procedures under these laws and their IRRs.
