NHA-Memorandum Circular No. 2018-010 establishes comprehensive guidelines and security measures to enhance compliance with resettlement safeguards, ensuring the protection of NHA housing projects from illegal occupancy while clarifying the roles of involved offices in managing such situations.

To ensure that NHA resettlement projects are safe and free from any intrusion and/or illegal entry and/or occupancy, by strengthening the resettlement system and process safeguards for compliance of NHA projects.

To (1) provide project implementers standard procedures and guidelines on strengthening compliance to resettlement system and process safeguards, and (2) clarify roles and responsibilities of concerned NHA offices/departments in addressing situations involving illegal entry/occupancy.

NHA administered/managed projects specifically those titled in the name of the Authority.

It requires (1) billboards with a standard design/size at main/major entrance informing the public of the project as a government socialized housing project intended for low-income groups, (2) a security guard house at every entrance and other strategic locations, (3) physical barriers at entrances as an additional layer, and (4) 24-hour security with required minimum guard staffing.

At least two (2) security guards for each project site: one (1) on the designated guard house and one (1) roving guard; if more than one entrance/exit gate exists, at least one (1) security personnel must be deployed to such additional gates.

Security personnel must be equipped with handheld radios for constant communication with their Detachment Commander (DC) and/or Shift Supervisor (SS) and must report any unusual occurrence/deviation from normal activities; the DC/SS must submit the report to the NHA Project Office Management.

It allows CCTV installation managed by security personnel or HOA if no satellite office exists, with at least two (2) cameras at entrance/exit, a recorder, and a 32-inch monitor; if a satellite office exists, it requires wireless (with antenna) CCTV with at least two (2) cameras per gate/entrance and specified recorder/drive and monitor requirements.

Strict compliance with existing NHA relocation/reporting guidelines; submission of monthly updated inventory of vacant/disposable units and utilization/occupancy status; requests for certification of availability; submission of the approved Master List two (2) weeks before transfer; receiving project inspection and readiness preparations; beneficiary acceptance and signing of the Inspection and Acceptance Report (IAR).

To ensure that the receiving NHA project has available units ready to allocate, thereby ensuring legitimacy/correctness of relocation and preventing unauthorized occupancy.

It serves as proof that the beneficiary has accepted the unit and agreed to the lot/housing unit allocation.

Deed of Sale (DS), Conditional Contract to Sell (CCS) or Lease with Option to Purchase, and Usufruct, whichever is applicable.

Issuance of a Certificate of Award is ensured as proof of possession or ownership, but the certificate is non-transferable; unauthorized possession of the document does not equate to an award of the unit.

A mandatory orientation session on Occupancy Rules and Regulations and Housing Technology features/restrictions conducted by the receiving project, to impress relocatees proper care/use of the lot/housing unit and solicit participation in maintenance/conservancy.

It states that HOA organization/strengthening should be pursued for project maintenance and socio-economic services, citing Section 10 of RA 9904 affirming that HOA may exercise powers to ensure needs/interests of homeowners are met.

Under Section 10 of RA 9904, the HOA may regulate access/passage through subdivision/village roads to preserve privacy, tranquility, internal security, and safety/traffic order, provided public consultations are held, existing laws/regulations are met, authority of concerned government agencies is obtained, and proper memoranda of agreement are executed.

It requires monthly coordination and validation of relocated/resettled households between sending and receiving projects; unannounced periodic inspection/occupancy checks of awarded lots/units; regular surveillance/monitoring of unawarded lots/units; monthly surveillance/monitoring reports plus exception reports to the General Manager.

Submit a written incident report to the barangay and HOA for information/request for assistance; immediately engage the Philippine National Police (PNP) (NCR or Regional Office depending on location) and provide a written report; and adhere to NHA MC No. 2506 (Updated Standard Operating Procedures on Summary Eviction of Illegal Occupants and Dismantling of Structures) including activation of PEDMT and PIAC, proper notice of eviction/dismantling, and conduct of a pre-E/D conference.
