The DEC is the lone body that may recommend approval for the deputation of non-LTO government employees to the Assistant Secretary or Regional Director. No deputation may be done by the Assistant Secretary/Regional Director without a DEC recommendation.
LTO permanent employees whose work is directly and actually related to traffic law enforcement need not be deputized.
Central Office DEC: Executive Director (Chairman), Law Enforcement Service Director, and Traffic Adjudication Service Director (members). Regional DEC: Assistant Regional Director (Chairman), Chiefs of Operations Division and the appropriate District Office Head (members). If a member is unavailable, an alternate may be designated by the Assistant Secretary/Regional Director.
A person disqualified/disallowed and not recommended by the DEC may not appeal the denial/disallowance, provided it was rendered by the DEC with cause.
The DEC, through the TSD, must ensure continuing education and conduct update seminars whenever new laws, ordinances, orders, or system processes take effect or have taken effect during the validity of the deputation.
The circular requires modules on: (1) Historical Background, Organization, Functions of LTO; (2) Traffic Administration in the Philippines; (3) Motor Vehicle Registration; (4) Driver’s Licensing; (5) Traffic Law Enforcement background and objectives; (6) Traffic Laws, Rules and Regulations; (7) Traffic Law Enforcement Actions and related topics; (8) Filipino Values and Liabilities of Traffic Law; and (9) Enforcers deputized by the LTO.
Government employees in regular position items whose work is directly and actually related to traffic law enforcement; and officers of AFP/PNP/HPG/LGU/DPWH/DENR whose duties in their present assignment are directly and actually related to transportation and traffic law enforcement.
Certified true copy of Certificate of Employment/Appointment; endorsement from head of office/agency; two 2x2 photos signed at the back; certificate of no pending case (administrative/criminal) signed by the head of office; and clearance from law enforcement agencies (PNP/NBI).
Within five (5) days from the date of the examination.
Previously deputized agents who failed to surrender any deputation paraphernalia issued to them are disqualified from applying anew under these guidelines.
No. An enforcer whose deputation was revoked may no longer be deputized by the Assistant Secretary, and vice versa. The circular also requires communication between Regional and Central DEC about revoked deputations.
Examples include: discourteous conduct; extortion; negligence; insubordination; grave misconduct; abuse of authority; incompetence/inefficiency; corruption; failure to submit apprehension within 24 hours; failure to submit apprehension report; improper filling up of TOP; offense involving moral turpitude; separation from government service.
A written complaint may be filed with the DEC. Notice is served on the complainant and deputized agent. If the agent fails to appear, waiver of the right to adduce evidence is deemed. The DEC recommends motu proprio based on records and evidence, and the procedure is summary but allows the accused deputized agent/enforcer to file an answer.
No. No complaint with other government offices or courts, or decisions therefrom, are necessary for the DEC to render its decision on whether to revoke the deputation.
The revocation order is final and executory. The agent must surrender the deputation ID and TOP issued to them under pain of administrative liability, and the order is published in a newspaper of general circulation.
They must at all times wear their official uniform, official ID, and official LTO Deputation ID when making an arrest/apprehension and performing their duties.
They must: (1) inform the driver of specific violation(s) and allow settlement within 72 hours at the proper LTO venue; (2) completely fill up the TOP with required details and accurate violation codes/sections and penalties; (3) complete details of place/time and accident status; (4) command the driver to appear at the specified LTO District/Central Office within 72 hours; (5) require driver’s signature acknowledging appearance and consequences if not settled within 15 days (license suspension); (6) state specific facts/data for fair adjudication; (7) confiscate driver’s license and/or plates and issue TOP copy or impound unit/MVIR as applicable; and (8) submit apprehension report within 24 hours.
Strictly within twenty-four (24) hours from the apprehension, with the corresponding required document set (e.g., white copy together with the driver’s license) to the proper adjudicating venue, and the deputized agent must affix their signature.
They must surrender the used TOP booklet (pink copies) when requesting a new one, including a mandatory summary report of all apprehensions; and they must surrender the issued TOP booklet and deputation ID upon renewal/termination/revocation of deputation.
