Section 5(k) of Executive Order No. 202 provides the LTFRB the power and function to formulate, promulgate, administer, implement, and enforce rules and regulations on land transportation public utilities.
Section 13(a) of Commonwealth Act No. 146, as amended, grants the LTFRB jurisdiction, supervision, and control over all public services and their franchises, equipment, and other properties.
The LTFRB Law Enforcement Unit is reinstated to enforce rules and regulations related to land transportation, coordinate with agencies like LTO, PNP-TMG, and MMDA, and effectively ensure compliance and continuing improvement of public land transportation services.
The LTFRB Law Enforcement Unit must coordinate with the Land Transportation Office (LTO), Traffic Management Group of the Philippine National Police (TMG-PNP), Metro Manila Development Authority (MMDA), and other non-government organizations (NGOs).
The LTFRB shall have an Adjudication and Investigation Unit responsible for investigating cases involving violations of terms and conditions of certificates of public convenience and violations of LTFRB rules and policies.
The LTFRB is authorized to deputize selected personnel from government and non-government organizations or cause-oriented groups to assist in the performance of its law enforcement mandate.
Deputized personnel shall be entitled to benefits, incentives, and other privileges provided by the LTFRB.
The LTFRB must provide and formulate rules and regulations including the scale of fines and penalties for violations of LTFRB orders, policies, rules, and regulations.
This Memorandum Circular cancels and supersedes any and all previous issuances inconsistent with it.
It takes effect fifteen (15) days after the filing of three (3) copies with the UP Law Center and publication in a newspaper of general circulation or the Official Gazette, as required by Presidential Memorandum Circular No. 11, dated October 9, 1992.
