EO No. 560 cites Section 77 of Republic Act No. 9336 (General Appropriations Act of 2005), which allows the President to direct changes in organization and key positions in any department, bureau, or agency.
SPDA was created under Presidential Decree (PD) No. 690, as amended by PD No. 1703.
It is reactivated effective immediately.
SPDA is placed under the oversight of the Office of the Presidential Adviser on the Peace Process (OPAPP).
EO No. 560 requires SPDA to have a lean and professional organization.
Among others: (1) approve policies and implementing guidelines; (2) determine and approve organizational structure, staffing pattern, and pay scales; (3) review and approve annual work and financial plan and budget; (4) establish levels of authority and responsibilities of the Administrator and other officers; (5) submit an annual report to the President; and (6) perform other tasks assigned by the President.
The Chairman presides. The Administrator is ex-officio Vice-Chairman of the Board.
No. EO No. 560 states that except for the Administrator, no member of the Board shall perform day-to-day administrative or operations work, reflecting a separation between governance and operations.
SPDA is designated as the implementing arm for the economic catch-up plan under the 1996 GRP-MNLF Peace Agreement.
SPDA must properly coordinate with the Autonomous Regional Government (ARG) in the implementation of projects within the Autonomous Region in Muslim Mindanao (ARMM).
It repeals Section 6 of Executive Order No. 229 dated 21 July 2003.
SPDA must coordinate with the head of Special Order No. 1391 dated 3 August 2004 for the return to SPDA of its assets and funds.
SPDA may request assistance from other agencies as necessary, including the Commission on Audit (COA) and the Civil Service Commission (CSC).
An amount of Ten Million Pesos (P10M) is made available for reactivation, taken from the President’s Contingency Fund.
Subsequent budget shall be included in the General Appropriations Act.
It repeals or modifies all executive orders, rules and regulations, and other issuances or parts thereof that are inconsistent with EO No. 560.
It takes effect immediately upon its publication in a national newspaper of general circulation.
