Q&A (EXECUTIVE ORDER NO. 92)

Section 2 subparagraph b (v) of Executive Order No. 308 (1987), as amended by Executive Order No. 505 (1991), was further amended by Executive Order No. 92.

The amended function mandates the RDC to review and approve annual and multi-year regional infrastructure and other sectoral programs that require national government funding, including LGU-proposed programs, within specific timeframes.

The RDC must complete its review and forward its recommendations within sixty (60) days from submission of the program. For programs already pending as of the effectivity of the EO, the review period is thirty (30) days.

Failure of the RDC to submit recommendations within the prescribed periods shall be deemed equivalent to an approval of the particular infrastructure or sectoral program.

Proponent agencies should coordinate with the RDC at the early stage of project development, preferably at the identification or feasibility study preparation stage.

They must have made available the necessary requirements requested by the Council for effective review.

They are strongly urged to adopt the review procedure set forth in the Executive Order.

The National Economic and Development Authority (NEDA) Board is authorized to promulgate the necessary implementing rules and regulations.

All executive issuances, rules, and regulations or portions thereof inconsistent with the provisions of Executive Order No. 92 are repealed or amended accordingly.
