Republic Act No. 11228 mandates that all persons with disabilities (PWDs) in the Philippines are automatically covered by the National Health Insurance Program, with premium contributions paid by the government and employers, and specific health packages developed for PWDs.

Q&A (Republic Act No. 11228)

Republic Act No. 11228 mandates the automatic coverage of all persons with disabilities (PWDs) under the National Health Insurance Program (NHIP) of PhilHealth, with premium contributions for all PWDs paid by the national government, thereby amending Republic Act No. 7277 to provide mandatory PhilHealth coverage for PWDs.

Republic Act No. 11228 amends Republic Act No. 7277, also known as the "Magna Carta for Persons with Disability," particularly Title Two, Chapter III by adding a new Section 20-A on Mandatory PhilHealth Coverage.

The national government shall pay the premium contributions for all PWDs. However, for PWD members in the formal economy, the premium contributions shall be shared equally by their employers and the national government.

The funds necessary for implementing the Act shall be sourced from the National Health Insurance Fund of PhilHealth, which is earmarked from the proceeds of Republic Act No. 10351, the law restructuring the excise tax on alcohol and tobacco products.

Yes, PhilHealth is mandated to develop exclusive health packages for PWDs that address their specific health and developmental needs.

The Department of Health (DOH), in coordination with the Department of Social Welfare and Development (DSWD), the Department of Labor and Employment (DOLE), the National Council on Disability Affairs (NCDA), local government units (LGUs), and other relevant agencies and NGOs, are tasked with monitoring and evaluation.

LGUs are required to submit data on PWDs to the Department of Health (DOH) to help maintain an updated database of PWDs' health and development needs, facilitating effective implementation and monitoring of the Act.

The PhilHealth, in consultation with the DOH, DSWD, DOLE, NCDA, and national leagues of LGUs, shall promulgate the IRR within three (3) months from the effectivity of the Act.

The Act took effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.

All laws, decrees, executive orders, rules, and regulations or parts thereof that are inconsistent with RA 11228 are repealed, amended, or modified accordingly to ensure compliance with the new law.
