The regulation aims to address indiscriminate dumping/littering/throwing of garbage and solid waste in public places and waterways, promote cleanliness and sanitation in Metro Manila, and prevent/control environmental pollution pursuant to R.A. 7924.
“Open public place” includes roads, streets, sidewalks, easements, parks, bridges, alleys, overpasses, rivers/creeks/canals/drainage/estero/waterways, and similar open spaces. “Covered public places” include facilities like schools, offices, churches, auditoriums/stadiums/gymnasiums, theaters/cinemas, restaurants and other enclosed public eating places, markets, factories/plants, hotels, and similar places where people gather or stay.
It refers to the frontage, including up to the mid-span of the road/alley/avenue (excluding highways and major thoroughfares) from the edge of the street gutter/sidewalks fronting residential houses, dwelling units, and business/commercial establishments or offices.
It is unlawful to dump, throw, or litter garbage/refuse/solid waste in public places and immediate surroundings, including vacant lots, rivers, canals, drainage, and other defined ways; it also prohibits urinating, defecating, and spitting in public places.
Owners/residents, lessees/occupants of residential houses/dwelling units, vacant lots, and owners/proprietors/operators/administrators or dormitories/condominiums/commercial buildings and offices, including institutions like schools and churches, must sweep clean daily and maintain cleanliness of their respective frontage and immediate surroundings (including sidewalks and street gutters).
It prohibits bringing out garbage on the property line or any part of the road; instead, garbage must be stored in properly sealed plastic containers and brought outside only upon arrival of authorized garbage hauling trucks in their locality.
It makes it unlawful to place/store/dump construction wastes or debris, junked or under-repair vehicles, dilapidated appliances, and other immovable objects in any part of the road/street/avenue or sidewalk if it obstructs or impedes vehicular and pedestrian traffic.
They must clean and maintain cleanliness of their respective vehicles at all times and provide modest trash receptacles inside their vehicles.
It is unlawful for owners/operators/proprietors of public conveyance, trucks, lorries, tankers, delivery vans, and other transportation facilities to spill, scatter, or litter any kind or form of defined waste or any of their loads on any part of the road/street/avenue on their way to their destination.
It prohibits entering into a contract or offering services for a fee for domestic waste disposal to a group of households unless authorized/permitted by the concerned LGU or homeowners’ association in private subdivisions as livelihood projects aimed at reduction, recycling, and reuse.
It is unlawful for any person/group/corporations (including advertising and promotions companies, movie producers, professionals, and contractors) to post/install/display billboards, signs, posters, streamers, ads, and other visual clutters in parts of the road, sidewalk, center island, posts, trees, parks, and open spaces.
MMDA or deputized representatives/agents/sanitary enforcers must conduct regular daily inspections of residential and commercial establishments from 7:00 a.m. to 9:00 a.m. and from 5:00 p.m. to 7:00 p.m. to ascertain and establish compliance with Section 2, paragraph (c) (about garbage being brought out only upon arrival of authorized hauling trucks).
Violations of Section 2(a), (c), (e), and (f) carry an administrative fine of P500 or community service of one day. If the fine is not paid, after conviction, the violator faces P1,000 fine or imprisonment of 3 to 7 days of arresto menor, or both, at the court’s discretion.
These violations subject the owner/proprietor/administrator/operator/manager of any business establishment to an administrative fine of P1,000 or community service of three days.
If not paid, after conviction, the owner/resident/lessee/occupant or proprietor/manager of the affected residential or business/commercial establishment faces a fine of P2,000 or imprisonment of 7 days to 1 month of arresto mayor, or both at the discretion of the court.
For illegally dumping bulky waste/construction debris requiring hauling, the violator pays an additional hauling fee of P200 per cubic meter on top of the penalty. For junk vehicles towed by MMDA or its accredited twot trucks, a towing fee of P1,500 is added to the penalty.
If the apprehending officer is under the LGU concerned, 100% goes to the LGU. If the apprehending officer is an MMDA enforcer, 50% goes to MMDA and 50% to the LGU where the violation occurred.
