Title
Creation of Labangan Municipality
Law
Executive Order No. 245
Decision Date
Oct 3, 2003
Executive Order No. 245 organizes a portion of Pagadian into an independent municipality called Labangan, with its own local government officials, while Pagadian retains its territory.

Questions (EXECUTIVE ORDER NO. 245)

The barrios of Labangan, Tacuran, Binayan, Bokong, and Lantian, and the sitios of Sambulawan, Backay Dacu, Luya, Bulanit, Militar, Tagulo, Tonotungan, Tabuan, and Bagolupa were segregated from Pagadian to form Labangan.

It was issued pursuant to Section 68 of the Revised Administrative Code, upon the recommendation of the Secretary of the Interior.

The seat of government is at Barrio Labangan.

Pagadian retains its present territory minus the portion comprised in the municipality of Labangan.

It begins to exist upon the appointment and qualification of the mayor, vice-mayor, and a majority of the councilors.

The mayor, vice-mayor, and a majority of the councilors must be appointed and qualified.

It implies that before those appointments/qualifications, Labangan is not yet functioning as a full municipality with the corresponding authority and governance structure.

It is described as segregation of specific barrios and sitios from the municipality of Pagadian, then organizing them into an independent municipality called Labangan.

EO No. 245 states that the segregated barrios and sitios “are hereby segregated… and organized into an independent municipality under the name of Labangan.”

Labangan’s territory consists of the specific barrios and sitios enumerated in the EO, taken out of Pagadian.

To clarify the territorial devolution and prevent disputes about overlapping jurisdiction by expressly subtracting Labangan’s carved-out territory from Pagadian.

EO No. 245 was issued “upon the recommendation of the Secretary of the Interior,” indicating an administrative input before the President acted.

It is an Executive Order; it was signed by President Elpidio Quirino and countersigned by Teodoro Evangelista, Executive Secretary.

It provides the official promulgation date and constitutional/historical context for the validity and effectivity reference in legal interpretation.

It exemplifies that municipalities may be created by executive action when authorized by statute (here, Section 68 of the Revised Administrative Code), with defined territorial limits and a clear criterion for when the new unit begins operations.
