The Immigration Board of Commissioners presided over by the Commissioner of Immigration has exclusive jurisdiction to deport undesirable aliens.
The power is vested pursuant to Presidential Decree No. 830 (1975), Letter of Implementation No. 47 (1976), and Article VII, Section 17 of the 1987 Constitution in relation to the Administrative Code of 1987 (E.O. 292).
The Commissioner of Immigration is authorized to issue mission orders for verification and investigation of suspected illegal aliens, and if probable cause exists, to effect warrantless arrest of such aliens under certain conditions related to violations of immigration or Philippine laws.
Section 5, Rule 113 of the Rules of Court allows for warrantless arrest if the alien is found in flagrante delicto violating Philippine immigration laws.
The Commissioner must submit a monthly report to the Office of the President, with a copy furnished to the Secretary of Justice. The report should include deported aliens, their nationalities, and the grounds for their deportation.
Provisions of other executive issuances and department orders inconsistent with Executive Order No. 287 are repealed or modified accordingly.
It took effect immediately upon its promulgation on September 4, 2000.
