The policy is to implement an integrated program for the planning, development, financing, and operation of ports or port districts to promote regional development through the dispersal of industries and to expand port administration functions beyond traditional harbor development and cargo handling.
The Philippine Ports Authority has the authority to submit applications for the declaration of specific areas as Port Districts.
Applications must be accompanied by a survey plan indicating the geographical location of the area or areas to be declared as Port District with their boundaries properly delineated.
RDCs participate in the review and processing of applications to ensure alignment with their respective regional development plans.
The Philippine Ports Authority must consult local government officials and the concerned Regional Development Council before conducting detailed surveys.
The application must include the development program for port facilities with project components and basis (such as master plans, feasibility studies), and an inventory of existing land use and status of ownership of the areas.
Conflicts are forwarded to the National Economic and Development Authority (NEDA) Infrastructure Committee for resolution before submission to the Office of the President.
They are submitted directly to the Office of the President for consideration.
The NEDA Infrastructure Committee is authorized to promulgate the implementing rules and regulations.
It took effect immediately upon its signing on July 3, 1990.
