The IRR is titled as the “Implementing Rules and Regulations of Republic Act No. 11630,” specifically for the establishment and operation of the Santa National High School.
The rationale is that the provisions primarily apply to the administration, organization, and procedures for SNHS’s operation to achieve the purpose of offering a complete secondary education program, consistent with constitutional mandates and related education laws (RA 9155 and RA 10533).
It states that SNHS is established in Barangay Marcos, Municipality of Santa, Province of Ilocos Sur, known as the Santa National High School, and is under the supervision of DepEd.
Learning facilitators are defined as in Section 3(i) of RA 9155: key-learning support persons responsible for supervising/facilitating the learning process and activities of learners.
The IRR defines LSA as per DO No. 32, s. 2020: a person who works in collaboration with a teacher and contributes to learning opportunities that promote achievement and progression of learners.
Non-Teaching Personnel are defined as employees not directly involved in classroom teaching but indirectly and indispensably assisting educational services, including Administrative Officer, Accountant, Personnel Officer, Supply Officer, Records Officer, and other support staff.
DepEd must include SNHS in its program of expenditures and management information systems (including EBEIS and LIS), and ensure provision of basic education inputs compliant with minimum service standards appropriate to learners and teachers.
Examples include adequate instructional rooms (academic classrooms, computer room, science laboratory/workshop room) and ancillary facilities (multi-purpose rooms, library, clinic), plus instructional materials, tools, equipment, furniture, and water and sanitation facilities.
The School Head shall be appointed and compensated in accordance with RA 9155, Civil Service laws, and other applicable laws, rules, regulations, and guidelines.
Examples include: setting mission/vision/goals; creating a conducive teaching-learning environment; implementing curriculum and being accountable for learning outcomes; developing school education program and school improvement plan; administering/managing personnel and physical/fiscal resources; recommending staffing complement; encouraging staff development; and performing other assigned functions.
The School Head may accept them for upgrading competencies and improving/expanding facilities or providing instructional materials/equipment, but such donations/grants must be reported to the appropriate district supervisors and division superintendents.
DepEd shall create the items and recruit/deploy necessary personnel consistent with existing guidelines and standards on authorized manpower and staffing complement for different school sizes, and consistent with DBM, CSC, and other relevant agencies’ rules.
SNHS must implement the basic education curriculum formulated by DepEd in accordance with standards and principles under Section 10, Rule II of the IRR of RA 10533, and other relevant DepEd issuances.
Monitoring is by the concerned DepEd division and regional offices; the IRR states performance shall be closely monitored and reported through the school-based management operationalization system.
The Secretary of Education shall immediately include the operationalization of SNHS in DepEd’s program, and funding shall be included in the annual General Appropriations Act.
Effectivity: 15 days after publication in the Official Gazette or a newspaper of general circulation, and registration with the Office of the National Administrative Register (ONAR) at UP Law Center. Separability: if any part is declared unconstitutional, remaining provisions remain valid.
