Q&A (LTO MEMORANDUM CIRCULAR NO. ACL-2009-1189)

The primary goal is to streamline the validation process and eradicate the proliferation of Non Appearance Testing and Appearance Without Testing in Private Emission Testing Centers (PETCs).

IT Providers must ensure enhancements that protect data integrity with automated vehicle data and/or image translation and uploading without human intervention; seamless and timed procedures for emission test data capture, collection, transmission and validation; a backup procedure for validating images; and the capacity to reflect realistic traffic volumes and sense geographical limits among others.

The Circular shall take effect fifteen (15) days upon publication with U.P. Law Center and/or in three (3) newspapers of general circulation.

Only motor vehicles tested by a PETC within a specified geographical area will be allowed to be registered in a particular LTO District Office.

The system must be enhanced to allow the LTO to pinpoint the particular and actual PC being used by a PETC.

Non-compliance shall be subject to the penalties prescribed under Section 10.1, Department Order No. 2005-37.

The improvements must support all the necessary requirements of the Clean Air Act.

All Private Emission Testing Centers (PETCs) nationwide are covered by this Circular.

To ensure that images captured during emission tests can be validated properly, thereby enhancing the reliability and authenticity of the testing process.

The process of emission test data capture, collection, transmission, and validation must be seamless and restricted within a specified and timed procedure.
