Q&A (EXECUTIVE ORDER NO. 226)

Under the doctrine of command responsibility, a government official or supervisor can be held administratively accountable for neglect of duty if he has knowledge of a crime or offense committed by subordinates or others within his area of responsibility and fails to take preventive or corrective action before, during, or immediately after its commission.

Government officials, supervisors, officers of the Philippine National Police, and officers of other law enforcement agencies are primarily affected by Executive Order No. 226.

Neglect of duty occurs when an official or supervisor has knowledge that a crime or offense is or will be committed by subordinates or others under their jurisdiction but does not take appropriate preventive or corrective action.

Knowledge is presumed when the irregularities or illegal acts are widespread within their jurisdiction, have been repeatedly or regularly committed, or when members of their immediate staff or office personnel are involved.

The National Police Commission (NAPOLCOM), in coordination with the Department of Interior and Local Government (DILG) and the Civil Service Commission (CSC), are tasked with promulgating the necessary rules and regulations.

Violators, including government officials and supervisors, may be held administratively accountable for violating existing laws, rules, and regulations.

Executive Order No. 226 took effect immediately upon its issuance on February 17, 1995.

It ensures strict and effective management and control by supervisors, fosters responsive delivery of government services, and holds commanders accountable for the conduct and discipline of their subordinates.
