QuestionsQuestions (EXECUTIVE ORDER NO. 116)
To increase the subsistence allowance of all officers and enlisted personnel of the BJMP and the BFP from P30.00 per day to P60.00 per day, effective January 1, 1999.
Section 71 of R.A. 6975, which states that uniformed members of the BJMP and BFP shall continue to enjoy subsistence allowance and other allowances as provided by existing law.
Original: P30.00 per day. Increased: P60.00 per day.
Effective January 1, 1999.
The rising cost of basic commodities and food stuff made the P30.00 per day subsistence allowance inadequate to meet appropriate food and nutritional requirements.
Executive Order No. 18 dated August 25, 1998, which increased the AFP subsistence allowance to P60.00 per day effective September 1, 1998.
It increases the subsistence allowance for all officers and enlisted personnel of the BJMP and BFP from P30.00 to P60.00 per day.
It directs that the needed funds in CY 1999 shall be supported from the lump-sum appropriation under the Miscellaneous Personnel Benefits Program authorized in R.A. 8745 (the CY 1999 General Appropriations Act).
Necessary funds shall be incorporated in the annual regular appropriations of the BJMP and BFP under the Department of Interior and Local Government.
To issue implementing instructions necessary and proper to carry out the intent of the Executive Order.
It repeals or modifies all rules and regulations and other issuances (or parts thereof) that conflict with Executive Order No. 116.
It provides the baseline rule that BJMP and BFP uniformed members enjoy allowances under existing law, and EO 116 updates/adjusts the subsistence allowance amount consistent with that framework.
It includes both: all officers and enlisted personnel of the BJMP and the BFP are covered.
EO 116 adjusts the subsistence allowance amount, while the rest of the allowances and benefits continue under the scheme of existing laws referred to in R.A. 6975.
The President states that the issuance is made by virtue of powers vested by the Constitution and existing laws.
It was adopted on July 5, 1999, but the increased subsistence allowance takes effect on January 1, 1999, implying retroactive effect for the allowance.
It may require the BJMP/BFP and DILG to implement payroll adjustments and possibly provide for retroactive payment from January 1, 1999.
BJMP refers to the Bureau of Jail Management and Penology; BFP refers to the Bureau of Fire Protection.
It refers to the specific budget appropriation source within the CY 1999 General Appropriations Act that can be used to finance the benefit increase for that year.
EO 116 specifically increases the subsistence allowance; it does not by itself increase other allowances (quarter, clothing, COLA, hazard pay, etc.), which remain governed by their respective rules under existing law.
