EO 216 is issued to implement Section 12 of RA 6975, which provides for the shifting of primary responsibility for internal security between the DILG-PNP and the DND-AFP under specified conditions.
The DILG-PNP assumes the primary role in internal security operations, including the suppression of insurgency, effective January 1, 1995, except in areas specified in EO 216.
“Primary role” means providing the principal planning, direction, control, and resources for internal security operations, including suppression of insurgency.
“Support role” means assisting the lead agency with adequate personnel and material resources for internal security operations, including suppression of insurgency.
Under EO 216’s initial roles, the DND-AFP is in the support role while the DILG-PNP is the primary agency (except in the enumerated AFP-primary areas).
EO 216 calls upon the DND-AFP to undertake the primary role in: (a) all provinces in Mindanao; (b) Basilan, Sulu, Tawi-Tawi; (c) all provinces in Panay; (d) all provinces in Samar; (e) all provinces in the Cordillera Administrative Region (CAR); and (f) Southern Quezon and all provinces of the Bicol Region.
General law enforcement functions nationwide shall continue to be the primary concern of the DILG-PNP.
The EO states that the President may, upon the recommendation of the National Peace and Order Council, call upon the AFP to assume the primary role or approve turnover to the PNP depending on the security condition.
Role changes are decided by the President upon the recommendation of the National Peace and Order Council. The President may call upon the AFP to be primary in certain areas or approve turnover of primary responsibility to the PNP, based on the internal security condition in each area.
They must jointly prepare, for the approval of the President, Implementing Guidelines to enhance the internal security management system defining: the strategic concept, internal security condition levels, appropriate government responses for each level, and responsibilities for primary/support roles by agencies and forces.
Its purpose is to monitor internal security operations, determine the existing or projected internal security condition level per area, prepare integrated plans, facilitate inter-agency coordination, and prepare reports to the President regarding the internal security program and concerns.
It is a Joint AFP-PNP Secretariat, meaning it involves both the AFP and the PNP.
The Joint AFP-PNP Secretariat is tasked to determine the existing or projected internal security condition level in each area as part of the internal security management system.
It requires the preparation of Implementing Guidelines under Section 1 to ensure continued, consistent, integrated, and coordinated internal security measures, including defined strategic concepts, condition levels, responses, and agency responsibilities.
EO 216 takes effect immediately upon issuance.
EO 216 is dated December 16, 1994 and adopted on the same date (16 Dec. 1994).
