Q&A (DAR JOINT DAR-LRA MEMORANDUM CIRCULAR NO. 03, S.2012)

The Circular guides the implementation and use of the Philippine Land Registration and Information System (PHILARIS) for the electronic registration of titles and deeds involving the Comprehensive Agrarian Reform Program (CARP).

DAR implements Republic Act No. 6657, as amended by Republic Act No. 9700, which constitute the Comprehensive Agrarian Reform Program (CARP).

The Philippine Land Registration and Information System (PHILARIS) developed for the Land Registration Authority (LRA) is used for computerized processing of CARP-related transactions.

Yes. Under Sections 66 and 67 of Republic Act No. 6657, CARP-related transactions are exempted from taxes and fees related to land transfers and other charges.

IT Service Fees are charged for specific services rendered by LRA, including CARP-related transactions, as provided under Republic Act No. 7718 and the BOO Agreement between LRA and the project proponent.

DAR shall issue orders appointing and authorizing representatives called DAR Authorized Representatives (DAR-ARs) who shall transact with LRA and its Registries of Deeds.

The DAR-AR must present a valid Identification Card, a copy of which shall be retained by the Registry of Deeds or LRA office upon submission.

Requests are entered into the Certified True Copy, Certification, and Verification (CCV) Book in PHILARIS, which checks the database, assesses applicable IT Service Fees, and prompts payment before processing. The documents are printed as true electronic copies certified electronically and released upon client identification and acknowledgment.

Issuance of certified true copies of certificates of title is not allowed if the title is subject of an ongoing transaction. Processing may commence only after the transaction is released.

The JTWG interfaces with the LRA's Project Management Executive Committee to review and address system enhancements requested by DAR related to CARP-related transactions.

LRA prepares weekly Statements of Account based on transactions, which are validated and paid by the LRA-CARP Central Office within 30 calendar days. Payments are made to LRA via Manager's Check payable to Land Registration Authority for the account of the PNB Trust Banking Group as Escrow Agent.

A notice of denial is issued to the DAR-AR, who may elevate the matter en consulta within five days without withdrawing the documents; otherwise, the denial is considered final.

PHILARIS records date and time of requests, generates Claim and Assessment Slips for fees, electronically certifies documents through authorized officers' digital signatures, and stores scanned document images securely in its database.

All pertinent documents, deeds, and instruments are scanned and stored as digital images in the LRA database, and their basic information is encoded into the system for examination by designated CARP examiners before approval or denial.
