The circular is issued pursuant to Republic Act (RA) No. 1556, as amended by Presidential Decree (PD) No. 7 (Sept. 21, 1972), and by virtue of DA-AO No. 24 (Aug. 21, 1991) and NFA Circular 1992 No. 41 (May 18, 1992).

It covers applications for import permits for: feeds/feed additive supplements, trace minerals and choline chloride, feed grades/prepared animal feeds, veterinary drug/product premixes, certain water solubles (coded SEP 081.99.01 and SEP 081.99.09 for those not containing corn or corn substitutes), and other preparations of a kind used for animal food (n.e.s.).

All applications/requests for import permits for the covered products are enjoined to secure a BAI import permit from BAI-AFSD and observe the guidelines prior to importation and opening of the LC.

A new applicant must submit: (1) duly accomplished BAI application form; (2) pro-forma invoice; (3) samples of not less than 250 grams per product for analysis plus laboratory cost; (4) test procedures/protocol; (5) certificate of analysis, certificate of free sale, and certificate of product registration, authenticated by the Philippine consulate from the country of origin; (6) brochures/technical dossiers/literatures/scientific evidences; (7) copy of authenticated Foreign Agency Contract or notarized valid agreement with the manufacturer containing a stipulation that the manufacturer and trader are jointly responsible for quality; and (8) copy of authenticated government certificate attesting to manufacturer competence and reliability of personnel/facilities.

For old applications: submit a valid BAI license, duly accomplished BAI application form, latest import permit (for repeat order with same supplier), and pro-forma invoice. The circular also states BAI may request additional requirements.

The cancellation or delay must be reported to AFSD.

Import permits are valid for a maximum of 60 calendar days, covering the period from the date of issuance of the import permit up to the expected latest date of vessel arrival.

Non-compliance subjects the offender to prosecution and penalties under RA 1556 as amended by PD No. 7, and other applicable laws, rules, and regulations, without prejudice to administrative sanctions.
