LTFRB anchored the circular on Section 5, paragraph (k) of Executive Order No. 202, which empowers the Board to formulate, promulgate, administer, implement and enforce rules on land transportation public utilities, including requiring operators to equip/install/provide devices and rules to promote safety, protection, comfort, and convenience.

An Accreditation Committee evaluates applications and recommends approval or disapproval to the Board. The Legal Officer is one of the committee members.

The applicant is disqualified outright without any need for further evaluation.
