Q&A (MEMORANDUM ORDER NO. 162)

Confiscated logs, lumber, and other forest products that are either (a) not subject to any pending case in court or other offices, (b) without claimants or offenders against whom a case could be filed, or (c) found abandoned within forest areas with ownership unascertained and without claimants.

Qualified beneficiaries include Barangays, Municipal and Provincial Governments, and other government agencies that require forest products to enhance their public service functions.

The request must include: (a) Justification for the infrastructure construction/establishment, (b) Bill of materials and building plan approved by the Project Engineer (or a simple sketch plan for barangay projects), (c) Certification by the Provincial Auditor or Municipal Development Officer that no funds are available for purchase, and (d) Certification from the concerned CENRO/PENRO/Regional Office that the forest products are available for disposition.

Priority is given in this order: (a) Needy disaster victims certified by DSWD, (b) School Building Program by DECS and projects by DND/AFP Engineering Brigade, (c) Health Centers, (d) Public Markets, (e) Municipal Buildings, (f) Police Stations, (g) AFP camps, (h) DPWH projects benefiting many and covered by MOA with DENR, (i) Local Government Units with jurisdiction over the area where the products were confiscated, and (j) Commitments to provincial, regional, and national projects.

The approval must come from the Secretary of Environment and Natural Resources or their duly authorized representative, pursuant to DENR Administrative Order No. 38, Series of 1990, and DENR Memorandum Circular No. 12, Series of 1992.

The recipient must sign an acknowledgment receipt and submit it to the concerned CENRO/PENRO/Regional Officer.

The donee must submit a certification of completion jointly attested by the DENR official and Provincial Auditor, including: (a) Certification by the Project Engineer on project completion, (b) The species and volume of timber used from the donated materials, and (c) Photographs showing the completed project and the specific areas where the donated materials were utilized.

All inconsistent Memorandum Orders, Circulars, Rules, and Regulations are repealed or modified accordingly.

It took effect immediately upon approval on August 19, 1993.

It was promulgated by the President of the Philippines, Fidel V. Ramos, by virtue of the powers vested in him by law.
