The main purpose is to grant amnesty to former rebels of the Communist Terrorist Group (CTG) who have committed crimes punishable under the Revised Penal Code and special penal laws in furtherance of their political beliefs, to promote peace, reconciliation, and reintegration into society.
'Former rebels' are individuals who were once members of the CTG who have surrendered to the government and renounced their rebellious activities.
The term CTG includes the Communist Party of the Philippines, National Democratic Front, New People's Army, and their front organizations.
Crimes committed in pursuit of political beliefs punishable under the Revised Penal Code or special penal laws such as rebellion, conspiracy to commit rebellion, sedition, illegal assembly, assault, illegal possession of firearms related to rebellion, among others.
Yes. Excluded crimes include kidnap for ransom, massacre, rape, terrorism, crimes against chastity, drug-related offenses, grave violations of the Geneva Convention, genocide, crimes against humanity, war crimes, torture, enforced disappearances, and gross human rights violations as identified by the UN.
No, individuals proscribed or charged under RA No. 9372 (Human Security Act of 2007) or RA No. 11479 (Anti-Terrorism Act of 2020) are excluded from this amnesty.
Applicants must file a written and sworn application admitting their guilt for the offense, surrender any firearms or explosives in their possession, and the crime must have been committed prior to the issuance of this Proclamation.
An Amnesty Commission is created to receive, process applications, and determine the eligibility of applicants for amnesty.
Amnesty extinguishes any criminal liability for acts committed in pursuit of political beliefs but does not affect civil liability for damages caused to private persons.
Yes. It restores civil or political rights that were suspended or lost due to criminal conviction.
Yes. All sworn applications and related testimony or evidence not otherwise available to the prosecution cannot be used against the applicant except for offenses such as perjury related to the amnesty application.
Applications must be filed within one (1) year from the effectivity of the Proclamation.
No, persons already granted amnesty under previous proclamations are disqualified, except those whose applications were invalid due to filing outside the reglementary period may apply.
Such declaration does not affect the validity of the other provisions of the Proclamation (separability clause).
It takes effect upon concurrence by a majority of all the Members of Congress.
