EO No. 11 cites Section 17, Article VII of the 1987 Constitution, which vests in the President the power of control over all executive departments, bureaus, and offices, and the mandate to ensure the faithful execution of laws.
It is Section 31, Chapter 10, Title III, Book III of EO No. 292 (Administrative Code of 1987).
EO No. 1 (s. 2022) reorganized the Office of the President, including the immediate offices and agencies under or attached to it, and also reorganized the Common Staff Support System.
EO No. 11 provides that the Office of the President shall consist of (1) the Executive Office, (2) the Office of the Chief Presidential Legal Counsel, (3) the Private Office, (4) the Office of the Special Assistant to the President, and (5) the Presidential Communications Office—each under the direct control and supervision of the President, thus directly reporting to the President.
The Executive Office consists of the Office of the Executive Secretary; Office of the Senior Deputy Executive Secretary; Office of the Deputy Executive Secretary for General Administration; Office of the Deputy Executive Secretary for Legal Affairs; Office of the Deputy Executive Secretary for Finance and Administration; and the Internal Audit Office, including the respective offices attached to them.
The Executive Office is headed by the Executive Secretary, who exercises control and supervision over all offices under or attached to the Executive Office.
It provides legal advice and assistance to the President, and performs other duties and functions as the President may assign.
The Private Office—including the Protocol Office and Social Secretary’s Office—provides direct services to the President, attending to matters that are personal or pertain to the First Family.
It has control and supervision over Presidential Assistants and the Presidential Legislative Liaison Office.
The Office of the Press Secretary is renamed as the Presidential Communications Office. It is responsible for crafting, formulating, developing, enhancing, and coordinating the messaging system of the Executive branch and the Office of the President.
The PMS, under the Office of the Executive Secretary, provides staff assistance to various offices under the Office of the President, performs functions of the Cabinet Secretariat (agenda topics and facilitating cabinet meetings), supervises the Cabinet Clusters System, and exercises administrative supervision over the Correspondence Office.
EO No. 11 states the Executive Secretary continues to exercise administrative supervision over offices and agencies attached to or under the Office of the President and other Executive Offices—those placed under the chairmanship of the President, those under the control and supervision of the President, those attached for policy/program coordination, and those not placed by law/order under any specific department.
It is limited to general oversight to ensure operations are managed effectively, efficiently, and economically, without interference with day-to-day activities, consistent with Section 27(5), Chapter 9, Title III, Book III, in relation to Section 38(2), Chapter 7, Book IV of EO No. 292.
Section 4 provides that all offices and agencies under the Office of the President shall continue to operate and function under their existing mandates as prescribed by relevant laws or issuances.
If any part or provision is held unconstitutional or invalid, the other unaffected parts remain in full force and effect.
Section 6 states EO No. 11 amends or modifies relevant provisions of EO No. 1 (s. 2022), and that all inconsistent issuances, orders, rules, and regulations (or parts thereof) are repealed, amended, or modified accordingly.
It takes effect immediately (Section 7).
