Executive Order No. 287 establishes new operational guidelines for the Commissioner of Immigration in the interest of national security, public safety, public health, and/or national interests.

The power and authority to deport undesirable aliens is within the exclusive jurisdiction of the Immigration Board of Commissioners presided over by the Commissioner of Immigration, pursuant to Presidential Decree No. 830, Letter of Implementation No. 47, and the Administrative Code of 1987 (E.O. 292).

Under Article VII, Section 17 of the 1987 Constitution in relation to E.O. 292, the Commissioner of Immigration is under the control of the Chief Executive regarding the authority to deport undesirable aliens who violate immigration laws, rules, and regulations.

Yes, if probable cause exists and the alien is found in flagrante delicto violating Philippine Immigration laws, the Commissioner or Acting Commissioner may authorize warrantless arrest in accordance with Section 5, Rule 113 of the Rules of Court.

Appropriate officers of the Bureau of Immigration, whether organic or on detail, may be directed by the Commissioner to conduct such operations.

The Commissioner must furnish a monthly report of deported aliens specifying their nationalities and the grounds for deportation, with a copy furnished to the Secretary of Justice.

Any provisions of other executive issuances and department orders inconsistent with EO No. 287 are repealed or modified accordingly.

This Executive Order took effect immediately upon issuance on September 4, 2000.

It seeks to protect national security, public safety, public health, and other national interests by managing undesirable aliens who pose clear and present dangers in the Philippines.
