Q&A (PROCLAMATION NO. 132)

The main purpose of Proclamation No. 132 is to exclude a certain parcel of public domain in the municipality of Parang, Province of Cotabato, from the operation of the U.S. Executive Order of February 15, 1904, and Proclamation No. 5, series of 1909, and to reserve it for townsite purposes subject to the Public Land Act.

The Executive Order of the President of the United States dated February 15, 1904, and Proclamation No. 5, series of 1909, of the then Governor General of the Philippines are excluded from operating on the described land.

The specific land reserved is a parcel situated in the municipality of Parang, Province of Cotabato, Island of Mindanao, more particularly described in the Bureau of Lands plan Tb-102, containing approximately 5,998,205 square meters.

The land is bounded on the NW, NE, and SE by Parang Military Reservation; on the S by a 20-meter wide national road and Polloc Harbor; on the SW by public land private property and the Nitnan River; and on the W by Polloc Harbor.

A contiguous portion containing 200 hectares located at the northern part of the land and farthest from the present Parang townsite shall be returned to the Parang Military Reservation and not subject to entry and disposition under the Public Land Act.

The delimitation survey must be executed by the Bureau of Lands in consultation with the municipal authorities of Parang, Cotabato.

The reservation of the land for townsite purposes is subject to private rights, if any there be, meaning existing private claims or ownership rights are recognized and protected.

Excluding the land means it is no longer governed or restricted by the provisions of the Executive Order of 1904 and Proclamation No. 5, 1909, thereby allowing its disposition and reservation under the Philippine Public Land Act for townsite purposes.

Proclamation No. 132 was signed by President Elpidio Quirino of the Philippines and countersigned by the Executive Secretary, Teodoro Evangelista.
