Proclamation No. 370
Decision Date
Oct 18, 2023
President Rodrigo Duterte designates land in Rosario, Cavite to be included in the Cavite Economic Zone II Special Economic Zone, in accordance with Republic Act No. 7916 and Republic Act No. 8748, aiming to promote investments, job creation, and economic development in the area.

Questions (PROCLAMATION NO. 370)

Under RA 7916 (Special Economic Zone Act of 1995), as amended by RA 8748, the President is empowered to designate areas for inclusion in existing or prospective special economic zones, upon recommendation of the Philippine Economic Zone Authority (PEZA).

The existing Cavite Economic Zone II – Special Economic Zone.

PEZA’s Board of Directors must recommend inclusion, as reflected by the mention of PEZA Board Resolution No. 15-383 (s. 2015).

Ninety-Six Thousand Twenty-Two square meters (96,022 m²), more or less, subject to the technical descriptions in the proclamation.

Lot 3027: covered by TCT No. 288211 (RS-04-G0330Z, LRC Rec. No. 5964). Lot 3028: covered by TCT No. T-596117 (Lot 3028, FRS-04-005746).

They are located in the Municipality of Rosario, Province of Cavite.

Barangay of Ligtong.

The designation is made subject to the provisions of RA 7916 (as amended), its Implementing Rules and Regulations (IRR), and PEZA Board Resolution No. 15-383 (s. 2015).

Because it signals that the inclusion has statutory and regulatory conditions; non-compliance with RA 7916/IRR requirements or the specific PEZA resolution could affect validity, implementation, or the effect of the designation on incentives and zone operations.

Lot 3027: Fifty-Seven Thousand Three Hundred Eighty square meters (57,380 m²). Lot 3028: Thirty-Eight Thousand Six Hundred Forty-Two square meters (38,642 m²).

Boundaries are described using lines identified by bearings and distances, with reference to natural/physical features and neighboring lots such as creeks and Manila Rail Road, and adjoining titled/estate parcels (e.g., San Juan de Dios Estate, San Francisco de Malabon Estate).

It is crucial for identifying the exact parcels being included; the legal effect depends on precise delineation so that the correct titles/areas are covered and there is certainty for boundary and mapping issues.

The original survey was July 1905 to April 1908. The resurvey mentioned for Lot 3027 was June 17, 2000, approved on February 23, 2001.

Proclamation No. 370 is dated November 28, 2017 (the signing date), while the printed reference indicates it was published in the Official Gazette on December 11, 2017. The signing date is the key date stated in the proclamation itself.

It is signed by President Rodrigo Roa Duterte, and attested by Executive Secretary Salvador C. Medialdea.

It brings the designated land area within the coverage of the special economic zone’s legal framework under RA 7916/IRR, enabling the zone’s governance and related economic zone mechanisms (such as regulatory coverage and the potential application of zone-related incentives, subject to applicable laws and requirements).
