Law

Decision Date
Jul 6, 2021
Executive Order No. 144 declares and delineates the Palompon Port Zone in Palompon, Leyte, placing it under the administrative jurisdiction of the Philippine Ports Authority (PPA) to establish and develop necessary port facilities for regional shipping trade, repealing conflicting laws and regulations.

Questions (EXECUTIVE ORDER NO. 144)

It declares and delineates the territorial coverage of the Port of Palompon and places that port zone under the administrative jurisdiction of the Philippine Ports Authority (PPA) for proper zoning, planning, development, and utilization of port facilities.

It delineates the port zone using a metes-and-bounds description starting from point 1 and following specified bearings and distances to points 2 through 21 and returning to the point of beginning.

The port zone is situated in the Municipality of Palompon, Province of Leyte.

It is an area of 202,155 square meters, more or less.

The Palompon Port zone is placed under the administrative jurisdiction of the Philippine Ports Authority (PPA).

The PPA must, consistent with the regional industrial plans of the government, implement a program for the proper zoning, planning, development, and utilization of the port.

EO No. 144 mainly governs jurisdiction and mandates PPA to implement zoning, planning, development, and utilization programs; it does not itself directly build facilities.

All issuances, orders, rules, and regulations, or parts thereof, inconsistent with EO No. 144 are repealed, amended, or modified accordingly.

It provides that if any provision is declared invalid or unconstitutional, the remaining provisions not affected shall remain valid and subsisting.

It takes effect immediately upon publication in a newspaper of general circulation.

It precisely identifies the geographic limits of the port zone so that jurisdiction and planning/development responsibilities can be applied accurately.

It requires PPA’s zoning and development planning to be consistent with the government’s regional industrial plans, linking port administration to broader economic planning.

Section 1 contains the factual/legal delineation of the port zone boundaries; Sections 2–5 address jurisdiction (PPA), repeal of inconsistent rules, separability, and effectivity.

Administrative control over zoning, planning, development, and utilization of the port zone shifts to or is centralized under PPA, guiding how port-related activities and facilities within the zone are managed.
