Questions (PRESIDENTIAL DECREE NO. 1236)

The decree states it is issued by the President “by virtue of the powers in me vested by the Constitution,” and is ordered “as part of the law of the land.”

Barangays Gatub and Bagong Kahayag (from the Municipality of Kumalarang), and Barangays Lakewood, Bolalawan, Sebugay, Bisuangan, Lokoan, Backing, Dagum, Sapang Pinolis, Tubod, Gasa, Tiwales, and Matalang (from the Municipality of Lapuyan).

The seat of government is in Barangay Lakewood.

Except as otherwise provided in the decree, all provisions of law applicable to regular municipalities shall apply to the Municipality of Lakewood.

The present elective municipal officials of Lanuyan continue to perform their duties as officials in Lakewood until municipal officials are appointed by the President. The appointed officials then serve until their successors are elected in the next regular elections and have qualified.

They are appointive officers appointed by the President; they hold office until successors elected in the regular elections following the issuance of the decree have qualified, unless removed sooner at the pleasure of the President.

It authorizes appointment of necessary officers and employees to organize or complete the government personnel of Lakewood, as provided under existing laws.

Upon effectivity, Lakewood’s proportionate share in the obligations, funds, assets, and other property of the former municipalities of Kumalarang and Lapuyan is transferred to Lakewood by the President upon recommendation of the Commission on Audit.

It recommends the transfer arrangements to the President regarding Lakewood’s proportionate share in obligations, funds, assets, and other property.

All laws or parts of laws, and executive orders or regulations, inconsistent with the decree are repealed or modified accordingly.

It takes effect immediately upon issuance/effectivity of the decree.

It triggers the immediate transfer process of Lakewood’s proportionate share in obligations, funds, assets, and property, subject to the President’s action upon Commission on Audit recommendation.

It emphasizes self-reliant communities, faster administrative response to social/cultural/economic needs, close supervision by local officials, and support for intensified governmental development projects.

It provides transitional continuity by allowing present elective municipal officials (as stated in the text) to continue performing their duties in the newly created municipality until officials are appointed by the President.

By detaching specific barangays from two municipalities—Kumalarang and Lapuyan—and constituting them into a single distinct and independent municipality named Lakewood.
