QuestionsQuestions (PRESIDENTIAL DECREE NO. 1133)
The decree states that its purpose is to hasten economic development, especially in Muslim Mindanao, improve administrative efficiency, create self-reliant communities, and support the pacification and restoration of normalcy in the area through intensified government development programs.
Barangays Tuka, Buadiposo-Lilod, Pualas, Lumbatan II, Tarik, Sapot, Gata, Villa-Tangkal, Tamporong, Bangon I, Katogonan, Tagondingan, Buadiposo-Proper, Lumbac, Minanga, Cadayonan, Kabasaran, Lumbatan III, Tangkal, Baital, Raya-Bubong, Bubong, Bacolod, Pendolongan, Lumbatan I, Dansalan, Manacab, Buntong, Raya-Buntong, Bangon II, Kalakala, and Paling.
No. Section 1 expressly provides that the creation of Buadiposo-Buntong does not affect in any manner the legal existence of the mother municipality of Ditsaan-Ramain.
The seat of government is in Barangay Manacab.
It provides that, except as otherwise provided in the decree, all provisions of law applicable to regular municipalities shall be applicable to Buadiposo-Buntong.
They continue to perform their duties as officials in the newly created municipality until municipal officials are appointed by the President.
They hold office until their successors shall have been elected in the regular elections for municipal officials following the issuance of the decree and shall have qualified, unless removed at the pleasure of the President.
Such officers and employees are appointed as provided for under existing laws.
The President transfers the proportionate share to the newly created municipality upon recommendation of the Commission on Audit.
It includes obligations, funds, assets, and other property of the Municipality of Ditsaan-Ramain.
It repeals or modifies accordingly all laws or parts of laws, and executive orders or regulations, inconsistent herewith.
It takes effect immediately, as stated in Section 7.
PD 1133 was issued by President Ferdinand E. Marcos by virtue of the powers vested by the Constitution.
It is declared to be 'as part of the laws of the land,' meaning it has the force of law upon effectivity.
It is described as a 'distinct and independent municipality.' This implies it becomes a separate LGU with the status of a regular municipality, subject to applicable municipal laws.
It creates a transitional arrangement: existing elective officials continue in office, then the President appoints officials, until the next regular municipal elections after the issuance of the decree.
