The purpose of Memorandum Order No. 266 is to create a Committee on Decorum and Investigation (CODI) of Sexual Harassment Cases in the Office of the President to handle complaints, investigate, and make recommendations on sexual harassment cases involving public officials and employees of the Office who are non-presidential appointees.
The CODI is composed of five (5) members: two (2) Management Representatives (one of whom shall be the Chairman), one (1) Second Level Employees' Representative, one (1) First Level Employees' Representative, and one (1) Accredited Union Representative.
A quorum consists of a majority of the members of the CODI.
The CODI shall receive complaints of sexual harassment, investigate complaints according to the prescribed procedures per CSC Resolution No. 01-0940, submit reports with recommendations to the Internal Affairs and Complaints Committee (IACC), and lead discussions within the Office of the President to prevent sexual harassment incidents.
The CODI acts as the Preliminary Investigator of all sexual harassment cases against public officials and employees of the Office of the President who are non-presidential appointees and submits findings to the IACC within five working days after concluding the preliminary investigation.
The CODI must observe the Civil Service Commission Administrative Disciplinary Rules and Regulations, Resolution No. 01-0940 on sexual harassment, the Uniform Rules on Administrative Cases in the Civil Service, and the Administrative Code of 1987 (EO 292).
The CODI is authorized to examine documents ex parte from other government agencies, require parties to submit affidavits and counter-affidavits, and summon parties to a conference for investigation purposes.
The CODI submits its findings and recommendations to the Internal Affairs and Complaints Committee (IACC) through the IACC Chairman.
Memorandum Order No. 266 took effect immediately upon its issuance on July 20, 2007.
