Questions (PRESIDENTIAL DECREE NO. 1327)

PD 1327 detaches and separates the subdivisions Baltao, Airlanes Village, Jetlane Village, Gat Mendoza and Vitalez (all in Barangay Tambo) and creates them into a distinct and independent barangay to be known as Barangay Vitalez, without affecting the legal existence of Barangay Tambo.

Baltao, Airlanes Village, Jetlane Village, Gat Mendoza, and Vitalez.

No. PD 1327 expressly states that the creation of Barangay Vitalez shall not affect in any manner the legal existence of the mother barangay Tambo.

All provisions of law now or hereafter applicable to regular barangays shall be applicable to Barangay Vitalez, except as provided in PD 1327.

The President appoints barangay officials for Barangay Vitalez. The present elective barangay officials of Barangay Tambo continue in their duties in Barangay Vitalez until appointive officials are appointed by the President.

They continue until the barangay officials of Barangay Vitalez are appointed by the President.

They hold office until their successors are elected in the regular barangay elections following the issuance of the Decree and shall have qualified; however, they may be removed earlier at the pleasure of the President.

The proportionate share of Barangay Vitalez in the obligations, funds, assets, and other property of Barangay Tambo shall be transferred by the President to the newly created barangay.

The President transfers upon the recommendation of the Commission on Audit.

It requires that the transfer be made by the President upon the recommendation of the Commission on Audit.

All laws or parts of laws, as well as executive orders or regulations, inconsistent with PD 1327 are repealed or modified accordingly.

It took effect immediately upon its effectivity clause (Section 6).

There is a continuity mechanism: elective officials from Barangay Tambo continue performing duties in the newly created Barangay Vitalez until new officials are appointed by the President.

It states that the President acts by virtue of powers vested by the Constitution.

It relies on existing laws: Section 3 states that necessary appointive officers and employees to organize/complete barangay personnel shall be appointed as provided for under existing laws.

As a policy justification for creating a separate barangay to better achieve socio-economic and political goals through closer local supervision of government projects.
